Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and 4 Precision Ltd ("Rightee", "we", "us", "our") and govern your use of the Rightee mobile application, the Rightee Apple Watch app, our website at https://rightee.golf, and any related services (together, the "Service").
By creating a Rightee account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

These Terms should be read alongside our Privacy Policy and our Community Guidelines, which form part of this agreement.
1. Eligibility and age requirements
1.1 You must be at least 13 years old to create a Rightee account.
1.2 If you are under the age at which you can consent to online services in your country (this is 13 in the United Kingdom and may be up to 16 in parts of the European Economic Area), you may only use the Service with the consent of a parent or guardian, and that parent or guardian agrees to these Terms on your behalf.
1.3 You must be at least 18 years old to use the side games and wagering features described in section 8.
1.4 If we believe you are under the minimum age for the Service, or for a particular feature, we may restrict your access, suspend your account, or delete it.
1.5 You must not use the Service if we have previously terminated your account or banned you.
2. Your account
2.1 You must give accurate registration information, including a valid email address, and keep it up to date.
2.2 You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us immediately at contact@4precision.co.uk if you think your account has been compromised.
2.3 One person, one account. Do not share your account, sell it, or transfer it.
2.4 You can delete your account at any time from within the app (Settings, then Delete Account) or by emailing contact@4precision.co.uk. Deletion is explained in section 12 and in our Privacy Policy.
3. Licence to use Rightee
3.1 We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Service on devices you own or control, for your own non-commercial use, in accordance with these Terms and the Apple App Store Terms of Service.
3.2 This is a licence, not a sale. We and our licensors keep all rights in the Service.
3.3 You must not:
- copy, modify, adapt, translate, reverse engineer, decompile or disassemble any part of the Service, except to the extent the law does not allow us to restrict this;
- remove or obscure any copyright, trade mark or other proprietary notice;
- rent, lease, lend, sell, sublicense or otherwise make the Service available to a third party;
- use bots, scrapers, crawlers or other automated means to access, extract or copy any part of the Service or its data;
- attempt to gain unauthorised access to the Service, other users' accounts, or our systems;
- interfere with, overload or disrupt the Service or the networks it depends on;
- use the Service to build a competing product or service, or to train a machine learning model;
- use the Service in breach of any applicable law or regulation.
4. Subscriptions, free trials and billing
4.1 How subscriptions are sold. Rightee subscriptions are sold through Apple's App Store as auto-renewing in-app purchases. Apple is the merchant of record. Payment is charged to your Apple ID account.
4.2 Current plans and prices. Plans, prices, trial lengths and any promotional offers are shown in the app and on our App Store listing at the point of purchase. Prices vary by country and may change. We do not list prices in these Terms.
4.3 Free trials. Where a free trial is offered, it is available once per Apple ID unless we say otherwise. If you do not cancel before the trial ends, the subscription starts automatically and your Apple ID is charged. If you subscribe during a trial, any unused portion of the trial is forfeited.
4.4 Auto-renewal. Subscriptions renew automatically at the end of each billing period unless auto-renewal is switched off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours of the end of the current period.
4.5 How to cancel. You manage and cancel your subscription through your Apple ID settings, not through us. Go to Settings on your device, tap your name, then Subscriptions. Deleting the app does not cancel a subscription.
4.6 Price changes. If we increase the price of your subscription, Apple will notify you and, where required, ask you to consent before the increase takes effect. If you do not consent, your subscription will not renew at the new price.
4.7 Refunds. Because Apple is the merchant of record, refunds are handled by Apple under the Apple Media Services Terms and Conditions. Request a refund at https://reportaproblem.apple.com. We cannot process refunds directly. Nothing in this section affects any statutory cancellation or refund rights you have under the law of your country.
4.8 Restoring purchases. If you reinstall the app or change device, use Restore Purchases in the app to recover an active subscription linked to your Apple ID.
4.9 What a subscription gives you. A subscription gives you access to premium features as described at the point of purchase. We may add, change or remove features over time (see section 10). If we make a change that substantially removes value from your subscription, we will tell you and you may cancel.
4.10 Free features. Some features are available without a subscription. We may change which features are free at any time.
5. Golf data, Smart Aim and how you must use them
5.1 Advisory only. Smart Aim, GPS distances, wind and weather information, club recommendations, green maps, course data and statistics are provided for general guidance and entertainment. They are estimates, not instructions, and they may be wrong, incomplete or out of date. You are responsible for every shot you play and every decision you make on the golf course.
5.2 Accuracy. GPS accuracy depends on your device, satellite conditions, tree cover and other factors outside our control. Weather data comes from third party providers and may be delayed or inaccurate. Course data may not reflect recent changes to a course, temporary greens, tee positions, or hole locations.
5.3 Competition play and the Rules of Golf. This is important.
Under Rule 4.3 of the Rules of Golf (R&A and USGA), a player may use a device to obtain distance and direction information, but may not use a device to gauge or measure conditions that might affect play (such as wind speed, gradient or temperature), or to get a recommended line of play or club selection. Some Committees also prohibit distance measuring devices entirely by Local Rule.
Smart Aim, wind and weather compensation, and club recommendations are features of this kind. Do not use them in competition play. Rightee includes a Tournament Mode that restricts the app to distance information only. It is your responsibility to enable Tournament Mode, to check the Local Rules of any competition you enter, and to make sure the way you use the Service complies with them.
We are not responsible for any penalty, disqualification, loss of a competition, loss of prize money, or any other consequence arising from your use of the Service during competition play.
5.4 Handicap. Any handicap figure shown in Rightee is calculated using our own algorithm. It is not an official Handicap Index, it is not issued or endorsed by any national golf association or handicapping authority, and it cannot be used for official competition purposes. It is for your personal tracking only.
5.5 Safety. Rightee is not a safety device.
- Weather information in the app is not a lightning warning or severe weather warning system. Do not rely on it to decide whether it is safe to play. Follow the instructions of the course, the Committee and local warning systems, and stop play immediately if conditions become dangerous.
- Do not use the app while driving a vehicle or operating a golf buggy or cart.
- Stay aware of your surroundings, other players and other people on and near the course. Do not play a shot if there is any risk of hitting someone.
- Use of the Service does not remove your responsibility for safe play under the Rules of Golf and the rules of the course you are playing.
6. Location data
6.1 Core parts of the Service (GPS distances, Smart Aim, shot tracking, round recording) require access to your precise location, including while the app is in the background or your device is locked during a round.
6.2 You control location permissions through your device settings. If you switch location access off, those features will not work.
6.3 How we use location data is set out in our Privacy Policy.
7. Social features and user content
7.1 What social features are. Rightee lets you create a profile, connect with other golfers, share rounds and scorecards, post text and photos, comment, take part in leaderboards and groups, and send direct messages. Anything you upload, post, send or share is "User Content".
7.2 You are responsible for your User Content. You keep ownership of your User Content. You are responsible for it, and for making sure you have the right to post it.
7.3 Licence you give us. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, adapt, publish, display and distribute that User Content, for the purposes of operating, providing, securing, moderating and improving the Service, and for promoting the Service where you have separately agreed to that.
This licence lasts for as long as your User Content is on the Service, and ends when you delete the content or your account, except that:
- we may keep copies in backups for a limited period, as set out in our Privacy Policy;
- we may keep records of content we have removed or reported, where we need to for legal, safety or regulatory reasons;
- copies shared by other users (for example a round you shared into a group) may remain visible to those users;
- if we have used your content in a promotion or marketing material before you deleted it, that use may continue until the material is withdrawn.
7.4 You promise that. For every piece of User Content you post, you confirm that:
- you own it or have all necessary rights and permissions to post it;
- it does not infringe anyone's intellectual property, privacy or other rights;
- it does not breach our Community Guidelines or any law;
- if it shows another identifiable person, you have their permission (and, if they are under 18, their parent or guardian's permission).
7.5 What you must not post. Our Community Guidelines form part of these Terms and set out what is and is not allowed. In summary, you must not post content that is illegal, sexual, abusive, threatening, harassing, hateful, discriminatory, fraudulent, spam, or that promotes self-harm or violence, and you must not impersonate anyone or attempt to contact children for any improper purpose.
7.6 Moderation. We use automated filters and human review to prevent and remove content that breaches these Terms, our Community Guidelines or the law. This includes filtering of text and images at the point of posting.
We may, at any time and without notice, remove or restrict content, limit the visibility of content, suspend features, suspend or terminate accounts, and report content and accounts to law enforcement, where we reasonably believe this is necessary to comply with the law, to protect users (particularly children), or to enforce these Terms.
We do not review all User Content before it is posted and we do not guarantee that all content that breaches these Terms will be found or removed. We are not responsible for User Content posted by other users.
7.7 Reporting and blocking. Every piece of content and every profile in Rightee has a Report option. Every profile has a Block option.
- Report sends the content or account to us for review. We aim to review reports promptly and to act on them without undue delay. Where content is illegal or presents a risk to a child, we prioritise it.
- Block immediately prevents that user from contacting you, seeing your content or appearing in your feeds.
You can also report content or an account to us at contact@4precision.co.uk. If you are reporting content you believe is illegal, tell us what the content is, where it is, and why you believe it is illegal, and give us a way to contact you.
7.8 What happens after a report. If we remove your content, restrict your account, or take any other action against you as a result of a report or our own review, we will tell you what we have done and why, unless the law prevents us from doing so. You can appeal by emailing contact@4precision.co.uk within 30 days. We will review the appeal and tell you the outcome.
7.9 What other people can see. By default:
- Your content is private. Your rounds, scores, posts, photos, home course and statistics are visible only to connections you have accepted. You can choose to make individual content public.
- Your identity is discoverable. Your display name, profile photo and handicap can be found in search, and you may be shown as a suggested connection to other golfers, based on your phone contacts and on courses you have both played.
- Somebody who is not a connection can see your display name, your profile photo and your handicap. Nothing else. They cannot see your rounds, your home course, your posts or your statistics, and they cannot message you.
- Direct messages are connections only. Nobody can message you unless you have accepted them as a connection.
You can change these settings, including turning discoverability off, at any time in Settings.
7.10 Connection requests. Anyone can send you a connection request. Accepting one gives that person access to your content and the ability to message you. Only accept requests from people you know. You can remove a connection, and block a user, at any time. If you are a parent or guardian, talk to your child about this.
7.11 Intellectual property complaints. If you believe content on Rightee infringes your intellectual property, email contact@4precision.co.uk with: your contact details, identification of the work you say is infringed, identification of the content you say infringes it and where it is on the Service, a statement that you believe in good faith that the use is not authorised, and a statement that the information you have given is accurate. We will investigate and may remove the content. We may pass your notice to the user who posted the content. If your content is removed and you believe that was wrong, you can appeal using the same address.
We terminate the accounts of users who repeatedly infringe intellectual property.
8. Side games and wagering features
8.1 What these features do. Rightee includes formats such as Skins, Nassau, match play and team games. Where you and your playing partners agree a wager between yourselves, Rightee can record the stake you tell it about and calculate who owes what at the end of a round.
8.2 What these features do not do. This is important.
- Rightee does not handle money. No stake, wager, payment, deposit or winning is ever paid to, held by, transferred by, or processed through Rightee.
- Rightee is not a bookmaker, a betting exchange, a gambling operator or a gambling platform, and does not offer facilities for gambling. It is a scorekeeping and calculation tool.
- Rightee is not a party to any wager between you and any other person. We do not guarantee any wager will be honoured. We do not act as a stakeholder, escrow agent or referee.
- Any money that changes hands does so directly between you and the people you play with, entirely outside the Service, and entirely at your own risk.
8.3 Your responsibility. You are responsible for making sure that any wager you agree with other people is lawful where you are. Gambling laws differ by country and by state or province. If wagering between private individuals is restricted or unlawful where you are, do not use these features for that purpose.
8.4 Age. You must be 18 or over to use side games and wagering features. See section 1.3.
8.5 Accuracy. Calculations depend on the scores and settings you and other players enter. We do not guarantee they are correct and we are not responsible for any dispute, loss or shortfall arising from them. Check the numbers yourself.
8.6 We can remove these features. We may modify, restrict or withdraw side games and wagering features at any time, in any country, without notice.
9. Acceptable use
You must not use the Service to:
- break any law, or encourage or help anyone else to break any law;
- harass, bully, threaten, stalk, defame or impersonate anyone;
- post, send or store illegal content, including content that sexually exploits or endangers a child;
- send spam, chain messages, or unsolicited commercial messages;
- promote gambling services, run a competition or lottery, or solicit money from other users;
- collect or harvest other users' data;
- upload viruses, malware or anything designed to damage or interfere with software, hardware or data;
- misrepresent your scores or your identity in a way that affects other users, including in shared rounds, leaderboards or wagers;
- do anything that puts us in breach of a law or an agreement with a third party, including Apple.
10. Changes to the Service
10.1 We are actively developing Rightee. We may add, change, suspend or remove features, and we may change how the Service works, at any time.
10.2 Some features may be released as beta, preview or early access. These are provided as-is, may be unstable, may not work as described, and may be withdrawn without notice. Do not rely on them.
10.3 We do not guarantee that the Service will always be available or uninterrupted. We may suspend the Service for maintenance, security or technical reasons.
10.4 The Service depends on third party services (including Apple, Google Maps, our weather data providers and our hosting providers). If they fail or change, the Service may be affected.
11. Suspension and termination by us
11.1 We may suspend or terminate your account, or restrict your access to any part of the Service, with immediate effect if:
- you breach these Terms, our Community Guidelines or the law;
- we reasonably believe your account presents a risk to other users, particularly children;
- we are required to do so by law or by a regulator;
- you have not used the account for a long period and we have given you notice.
11.2 Where we can, we will tell you what we have done and why, and give you a route to appeal (see section 7.8). We may not do so where telling you would be unlawful, would prejudice an investigation, or would put someone at risk.
11.3 If we terminate your account, you lose access to your content and your round history. Terminating your account does not automatically cancel or refund an Apple subscription. You must cancel that through your Apple ID.
12. Ending this agreement and deleting your account
12.1 You can stop using the Service and delete your account at any time from Settings inside the app.
12.2 Deleting your account removes your profile, your posts, your messages and your round history from the Service. Some data is retained for a limited period, as set out in our Privacy Policy, including backups, financial records we are required to keep, and records relating to safety, moderation or legal claims.
12.3 Deleting your account does not cancel your subscription. Cancel through your Apple ID settings first, otherwise Apple may continue to charge you.
12.4 Sections that by their nature should survive termination (including sections 7.3, 13, 14, 15, 16 and 18) continue to apply.
13. Intellectual property
13.1 Rightee, the Rightee name and logo, Smart Aim, the app, the website, and all software, design, text, graphics, course data, algorithms and other material we provide are owned by or licensed to 4 Precision Ltd and are protected by intellectual property law.
13.2 Nothing in these Terms transfers any of those rights to you.
13.3 You may not use our name, logo or branding without our written permission.
14. Disclaimers
14.1 We provide the Service with reasonable care and skill. Beyond that, and to the extent the law allows, the Service is provided "as is" and we make no warranties, express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose or non-infringement.
14.2 We do not warrant that the Service will be uninterrupted, error free, secure, or that any data, distance, aim recommendation, weather reading, handicap figure, statistic or calculation it produces is accurate or complete.
14.3 We are not responsible for User Content, or for the conduct of other users, whether on the Service or off it, including in relation to any wager.
14.4 Nothing in this section affects your statutory rights as a consumer. If you are a consumer in the United Kingdom, you have legal rights under the Consumer Rights Act 2015 that cannot be excluded. If you are a consumer elsewhere, you have the rights given to you by the law of your country.
15. Our liability
15.1 What we do not exclude. Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any liability that cannot be limited or excluded by law, including your statutory rights as a consumer.
15.2 What we are not liable for. Subject to 15.1, and to the extent the law allows, we are not liable for:
- loss of profit, revenue, business, opportunity, goodwill or anticipated savings;
- loss or corruption of data, except where caused by our failure to use reasonable care and skill;
- any loss that was not reasonably foreseeable when you accepted these Terms;
- any penalty, disqualification or loss arising from your use of the Service in competition play (see section 5.3);
- any loss, dispute or shortfall arising from a wager between you and another person (see section 8);
- any injury or damage caused by your failure to play safely or to follow the rules and instructions of the golf course you are playing;
- the acts or omissions of other users;
- failure or interruption of a third party service the Service depends on, where that failure was outside our reasonable control.
15.3 Cap. Subject to 15.1, our total liability to you in connection with the Service, in any 12 month period, is limited to the greater of (a) the total amount you paid us or paid Apple for Rightee subscriptions in that 12 month period, and (b) £100.
15.4 Business use. The Service is provided for personal, non-commercial use. If you use it for any business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
16. Indemnity
If you use the Service in breach of these Terms and that causes a third party to bring a claim against us, you will be responsible for the reasonable losses, costs and legal fees we incur as a result. This does not apply to the extent the claim arises from our own breach or negligence, and it does not apply to consumers to the extent the law does not permit it.
17. Apple
You acknowledge and agree that:
17.1 These Terms are between you and 4 Precision Ltd only, not with Apple. Apple is not responsible for Rightee or its content.
17.2 Apple has no obligation to provide any maintenance or support for Rightee.
17.3 If Rightee fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation in relation to Rightee, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, not Apple's.
17.4 We, not Apple, are responsible for addressing any claim by you or a third party relating to Rightee, including product liability claims, claims that Rightee fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
17.5 We, not Apple, are responsible for investigating, defending, settling and discharging any third party claim that Rightee or your use of it infringes that third party's intellectual property rights.
17.6 You confirm that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
17.7 Apple and Apple's subsidiaries are third party beneficiaries of these Terms and, on your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary.

18. Changes to these Terms
18.1 We may change these Terms, for example to reflect new features, changes in the law, or changes to how the Service works.
18.2 If a change is material and affects you, we will give you at least 14 days' notice by in-app notice or email before it takes effect, unless we need to make the change immediately for legal or safety reasons.
18.3 If you do not agree to a change, stop using the Service and delete your account. Continuing to use the Service after a change takes effect means you accept it.
18.4 The date at the top of these Terms tells you when they were last updated.
19. Contact points and complaints
19.1 Users. Contact us at contact@4precision.co.uk or https://rightee.golf/contact/. This is our single point of contact for users under Article 12 of the EU Digital Services Act. You may contact us in English.
19.2 Authorities and regulators. Contact us at contact@4precision.co.uk. This is our single point of contact for Member State authorities, the European Commission and the European Board for Digital Services under Article 11 of the EU Digital Services Act, and for Ofcom under the Online Safety Act 2023. We accept communications in English.
19.3 EU legal representative. Our legal representative in the European Union under Article 13 of the Digital Services Act is:
19.4 Complaints. If you are unhappy with something we have done, email contact@4precision.co.uk and we will investigate.
20. Governing law and jurisdiction
20.1 These Terms and any dispute arising from them are governed by the law of England and Wales.
20.2 The courts of England and Wales have exclusive jurisdiction, except that:
- if you are a consumer resident in the European Economic Area, Switzerland or the United Kingdom, you may also bring proceedings in the courts of the country where you live, and you keep the benefit of any mandatory consumer protection law of that country;
- we may bring proceedings against you in the courts of the country where you live.
21. General
21.1 Entire agreement. These Terms, together with the Privacy Policy and the Community Guidelines, are the entire agreement between you and us about the Service.
21.2 Severability. If a court finds any part of these Terms unenforceable, the rest continues to apply.
21.3 No waiver. If we do not enforce a right, that does not mean we have given it up.
21.4 Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if our business is sold, provided this does not reduce your rights.
21.5 Third party rights. Nobody other than you, us and (under section 17) Apple has any right to enforce these Terms.
21.6 Events outside our control. We are not liable for any failure or delay caused by an event outside our reasonable control.
